Terms of service.
What you are agreeing to when you open an account. Where the product has not settled something — what happens when a plan’s allowance is passed, or the processing agreement — this says so rather than borrowing a clause that sounds decided.
Who you are agreeing with
FunnelSights is operated from the State of New Mexico, United States, and is the party you are contracting with.
These terms apply when you create an account, use the product, or use this website. If you are agreeing on behalf of a company, you are confirming that you can bind it. Questions about these terms go to support@funnelsights.com.
This version takes effect on 19 September 2026.
What the service is
FunnelSights is a hosted web analytics product. You install a script on sites you operate, it reports traffic, goals and events, journeys and drop-off, and it raises rule-based recommendations from your own figures. What it collects, and what it deliberately does not, is described on the privacy page and in the privacy policy.
Your account
- You are responsible for what happens under your account, including what people you invite to your workspace do in it.
- Keep your password to yourself. Tell us promptly if you think someone else has it.
- Give us accurate account details, and keep your email address current — it is how we reach you about the service.
- You must be old enough to enter a contract where you live, and at least 16.
The free trial
Every plan starts with a 14-day free trial, and we do not ask for a payment method to begin it. Nothing is charged during the trial, and a trial becomes a paid subscription only if you choose a plan and agree to pay for it.
Plans, fees and billing
These terms apply from the moment you choose a paid plan. While you are on a free trial, nothing in this section is charged.
- Plans are priced by monthly events, counted across every site in the workspace for a calendar month. A pageview or a custom event is one event; engagement pings are not billed.
- Prices are those published on the pricing page at the time you choose a plan, exclusive of any tax added at checkout.
- Every plan is paid in advance: a monthly plan buys the next 30 days, an annual plan the next year, at the discount shown on the pricing page.
- Payment is taken by Paddle, not by us. The billing and refund policy sets out the cycle, the renewal dates, the refund window and how to ask for one.
- You can cancel at any time, and cancellation takes effect at the end of the period you have already paid for. Outside the refund window we do not pro-rate a part-used period unless the law where you live requires it.
- If we change a price, we will tell you at least 30 days before it applies to you, and it will not apply before your next renewal. You can cancel instead.
If a payment fails
If a payment does not go through we will tell you and try again. You have 30 days from the first failure to put it right, and the service runs as normal throughout — reports stay available and the tracker keeps recording.
After 30 days the tracker stops accepting data for the workspace and the account becomes read-only. You keep access to everything already collected and can still export it; nothing new is recorded. Settling the amount restores normal service, but data for the period while ingest was stopped was never collected and cannot be filled in afterwards.
Read-only is not closure. Nothing is deleted at the end of that period — the retention periods and the deletion process in the privacy policy are what govern the data from then on.
Your data, and what we may do with it
The analytics data your sites send belongs to you. We process it to provide the service and for nothing else: we do not sell it, we do not pool it across customers, and we do not use it to train a model. You can export what the reports hold through the read API for as long as your account is open.
For that data you are the controller and we are your processor: we hold it on your instructions and use it to provide the service. Where a written processing agreement is required, ask us and we will put one in place.
You are responsible for having a lawful basis for the measurement you carry out with the product, for telling your own visitors what you need to tell them, and for what you choose to put into custom event properties. The product’s defaults collect no visitor personal data; a field you fill yourself is yours to justify.
What you may not do with it
- Use it to measure a site you do not operate or have permission to measure.
- Put special-category data, or anything you have no right to hold, into a custom event property or a site-search term.
- Attempt to identify an individual visitor from the data, or to re-derive a hashed identifier.
- Probe, scrape or attack the service, or try to reach a workspace that is not yours.
- Resell the product or present it as your own. White labelling is not built, and there is no reseller arrangement.
- Send us traffic at a volume that degrades the service for other customers, having been asked to stop.
Who owns what
We own the product, the software, and the FunnelSights name and marks. You own your data and your websites. Nothing here transfers either way: you get permission to use the product while your account is open, and we get permission to process your data in order to provide it.
If you send us feedback or a feature request, we may act on it without owing you anything for it. That is not a claim on anything else you own.
Availability
We commit to 99% availability of the dashboard and the ingest endpoint, measured across each calendar month. Scheduled maintenance announced to account holders in advance does not count against that figure.
We may change, suspend or withdraw features. Where a change removes something you rely on, we will give notice we reasonably can, and where it materially reduces what you are paying for you may cancel and be refunded for the unused part of what you have paid.
Warranties and liability
The service is provided as it is. Beyond what the law requires of us, we make no promise that it will be uninterrupted, error-free, or that the figures will match another analytics tool — they will not, and the pages on measurement explain why.
Neither of us is liable to the other for loss of profit, revenue, goodwill or anticipated savings, or for indirect or consequential loss. Our total liability to you in any twelve-month period is limited to the amount you paid us in that period; where you have paid nothing, that amount is nil.
None of this limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected by anything in this section.
Ending it
You can close your account at any time. We can suspend or close yours if you break these terms in a way you do not put right after we ask, if we are required to by law, or if we stop offering the service — in which case we will give as much notice as we can and refund the unused part of anything you have paid.
When an account closes, access ends. Export what you want to keep first. Closing an account does not by itself erase what is behind it: the retention periods in the privacy policy keep running, and if you want it gone sooner than those, ask in writing and we will delete it within 30 days.
Changes to these terms
We may change these terms. If a change matters to you — fees, liability, what you may do with the product — we will tell account holders before it takes effect, and continuing to use the service after that is acceptance. If you would rather not accept it, cancel and we will refund the unused part of anything you have paid.
The rest
These terms, and any dispute arising out of them, are governed by the law of the State of New Mexico, without regard to its conflict-of-laws rules, and the state and federal courts located in the State of New Mexico have exclusive jurisdiction. This does not remove any protection you have under the mandatory law of the country you live in.
